Website Service Agreement

This agreement is designed for the standard $99/month website design, hosting, basic updates, and maintenance service.

Plain-English summary: we build and host a simple website for your business while your subscription is active. You are responsible for approving your business information and content. If payment is not made, the website can be paused, unpublished, or shut down. We are not responsible for lost revenue, rankings, leads, or business outcomes.

1. Parties

This Website Service Agreement is between 99 Dollar Websites (“Provider,” “we,” “us”) and the customer, business owner, manager, or authorized representative who submits a claim form, approves a preview, pays through Stripe, or otherwise requests services (“Customer,” “you”).

2. Services

Provider may provide website preview, website design, hosting, SSL, basic updates, contact/action buttons, service copy, maintenance, and launch support for a local small business website.

The standard subscription includes reasonable basic updates such as contact details, hours, service lists, small copy edits, and similar maintenance. Larger redesigns, custom software, e-commerce, booking systems, advanced SEO, paid ads, custom integrations, or substantial new pages may require separate pricing and written approval.

3. Preview pages

Preview pages are mockups made from public or customer-provided information. A preview is not the business’s official website, and Provider is not affiliated with the business unless the Customer chooses to claim or approve the website. Customer is responsible for reviewing and correcting any business information before public launch.

4. Customer content and approval

Customer represents that they have the right to provide and authorize use of any business name, logo, photos, text, contact information, trademarks, or other materials they ask Provider to use. Customer is responsible for reviewing the website for accuracy, required disclosures, license information, legal requirements, and compliance with their industry rules.

5. Payment and subscription

The standard service is $99/month unless otherwise agreed in writing. Payments are processed by Stripe. Customer authorizes recurring billing while the subscription remains active. Stripe is the payment processor and may provide receipts, invoices, subscription records, and payment updates.

6. Non-payment, failed payments, and shutdown

If a payment fails, is reversed, disputed, cancelled, or remains unpaid, Provider may pause work, stop updates, remove public access, unpublish, redirect, or shut down the website without liability. Provider may also suspend support and domain/DNS assistance until the account is current.

Provider is not responsible for lost leads, lost revenue, search ranking changes, downtime, customer complaints, or business interruption caused by non-payment, failed billing, cancellation, chargebacks, domain issues, customer delay, third-party provider issues, or suspension of service.

7. Cancellation

Customer may request cancellation by emailing [email protected]. Cancellation stops future billing after processing. Provider may unpublish the website after cancellation unless a separate written transfer/ownership arrangement is made.

8. Ownership and license

Unless otherwise agreed in writing, Provider retains ownership of templates, code, layouts, processes, and internal systems used to create and maintain the website. Customer retains ownership of their own business name, logos, photos, and customer-provided materials. While the subscription is active and paid, Customer receives a limited license to use the hosted website for their business.

9. Domains and third-party accounts

Customer is responsible for domain ownership, domain renewal, domain registrar access, and third-party account access unless otherwise agreed in writing. Provider may assist with DNS or launch steps but is not responsible for domain expiration, registrar lockouts, third-party outages, or customer failure to maintain access/payment for external accounts.

10. No guaranteed results

Provider does not guarantee search rankings, Google Business Profile placement, traffic, leads, sales, revenue, customer conversion, uptime from third-party providers, or any specific business outcome.

11. Limitation of liability

To the maximum extent allowed by law, Provider’s total liability for any claim related to the service is limited to the amount Customer paid to Provider during the one month immediately before the claim. Provider is not liable for indirect, incidental, special, consequential, punitive, lost profit, lost revenue, lost data, lost goodwill, or business interruption damages.

12. Indemnification

Customer agrees to defend, indemnify, and hold Provider harmless from claims, damages, costs, chargebacks, disputes, or expenses arising from Customer-provided content, inaccurate business information, intellectual property claims, industry/legal compliance issues, customer products/services, or Customer’s use of the website.

13. Disputes and chargebacks

Customer agrees to contact Provider first at [email protected] to resolve billing, service, or cancellation concerns before initiating a chargeback or dispute when practical.

14. Agreement acceptance

Customer accepts this agreement by submitting a claim form, approving a preview, paying through Stripe, requesting launch, or continuing to use the service. This agreement works together with the Terms of Service, Privacy Policy, and Refund/Cancellation Policy posted on this website.
